2. BOOKINGS, CANCELLATION & REARRANGEMENT

2.1 Booking a Photography Session

Our photography sessions start from £395.

The final price of a session will depend on the requirements of the particular shoot and will be discussed and agreed with you following your consultation, before your booking is confirmed.

Depending on the shoot, the total price may include:

·       the base photography session fee;

·       additional travel time where the location is beyond our reasonable travel area;

·       venue hire, where required, including the time involved in arranging, setting up and dismantling the venue; and any other reasonable costs arising from specific requests or requirements for your shoot.

The total session price will be agreed with you before your booking is confirmed.

A booking is confirmed once the shoot details and total session price have been agreed and the required booking fee has been paid.

The cancellation and rearrangement provisions in this section apply where you wish to cancel or rearrange your photography session. If we need to cancel or rearrange your session, Section 3 of these Terms & Conditions will apply.

2.2 Booking Fee & Payment

A booking fee of 30% of the base photography session fee is payable when the booking is confirmed.

The booking fee reserves your session on your chosen date and time, and reflects the professional time and resources we commit to your session from the outset. This includes - but is not limited to - consultations, planning, preparation and other work undertaken before your photography session.

The booking fee is deducted from the total session price.

The remaining balance is due no later than 7 days before the date of the photography session.

The booking fee is non-refundable in accordance with the cancellation provisions below, subject always to any statutory rights you may have.

2.3 Payment of the Balance

The remaining balance must be received no later than 7 days before the date of your photography session.

If the balance has not been received by the due date, we will contact you to remind you that payment is outstanding.

We ask that you make this payment within 48 hours from our reminder.

If the balance remains unpaid after this 48 hour period, we will treat the booking as cancelled by you.

In these circumstances, the cancellation will be treated as a cancellation made with at least 3 clear days’ notice, and the standard cancellation provisions in Section 2.4 will apply.

We are not obliged to proceed with a photography session where the required balance remains unpaid.

If payment is subsequently received after the 48 hour period, the booking will only remain confirmed if we have agreed this with you in writing and the date is still available.

2.4 Cancelling Your Photography Session

We understand that circumstances can sometimes change, so if you need to cancel your photography session, please let us know as soon as possible.

For the purposes of these Terms & Conditions, “at least 3 clear days’ notice” means that we receive your cancellation or rearrangement request at least 3 full days before the agreed date of the photography session.

- Cancellation with at least 3 clear days’ notice

If you cancel with at least 3 clear days’ notice, the booking fee will be retained and no further standard cancellation charge will normally be payable.

If we have already incurred any unavoidable, non-refundable costs specifically for your photography session, such as venue hire or other agreed third-party costs, these may also be payable.

- Cancellation with less than 3 clear days’ notice

If you cancel with less than 3 clear days’ notice, the cancellation charge will be 50% of the base photography session fee.

The booking fee already paid will be credited towards this cancellation charge.

If you have already paid more than the applicable cancellation charge, we will refund the difference.

Any unavoidable, non-refundable third-party costs already incurred specifically for your photography session may also be payable.

2.5 Rearranging Your Photography Session

We understand that circumstances can sometimes change, so we allow one rearrangement of a photography session.

A rearrangement must be requested with at least 3 clear days’ notice of the original session date.

The rearranged session must take place within 21 days of the original session date, subject to our availability.

Once a session has been rearranged, the rearrangement cannot be moved again under this provision.

If a rearrangement is requested with less than 3 clear days’ notice, it will be treated as a cancellation under Section 2.4.

If a session has already been rearranged and is subsequently cancelled, the standard cancellation provisions in Section 2.4 will apply.

Any unavoidable, non-refundable third-party costs already incurred specifically for the photography session may also be payable.

2.6 No-Shows

A “no-show” means that the client or clients fail to attend the agreed photography session without providing the required notice.

This includes circumstances where:

·       we have travelled to a client’s home and the client or clients are not present and cannot be contacted;

·       we have travelled to an agreed outdoor location and the client or clients do not attend; or

·       we have arranged and travelled to a hired venue and the client or clients do not attend.

As a mobile photography business, a photography session may involve significant preparation, travel and other resources being committed in advance. A no-show also means that the time reserved for the session cannot normally be offered to another client.

Where a client does not attend a booked session without providing the required notice, the full agreed session price will become payable.

Any amount already paid will be credited towards the amount due.

Following a no-show, the one-time rearrangement opportunity described in Section 2.5 will no longer apply.

2.7 Statutory Rights

Nothing in these Terms & Conditions is intended to limit or exclude any rights you may have under applicable UK consumer law.

Where circumstances arise that give you a statutory right to cancel, terminate or obtain a refund, those rights will apply regardless of the cancellation provisions above.

3. CANCELLATION OR REARRANGEMENT BY CULVER HOUSE PHOTOGRAPHY

3.1 If We Need to Cancel or Rearrange Your Session

We will always make reasonable efforts to carry out your photography session as agreed. However, there may occasionally be circumstances in which we need to cancel or rearrange a session.

If this happens, we will contact you as soon as reasonably possible and explain the situation.

Where reasonably possible, we will first try to offer you a suitable alternative date or other reasonable solution.

3.2 Illness or Other Personal Circumstances

As Culver House Photography is operated by two photographers, there may be occasions where one of us is unable to attend due to illness, injury, a family emergency or another serious personal circumstance.

Depending on the nature of the photography session and the circumstances at the time, we may:

·       continue with the session using one photographer;

·       arrange for the session to take place on another suitable date; or

·       where neither option is reasonably possible, cancel the session.

We will make this decision based on the circumstances of the particular session and will always aim to find the fairest and most practical solution.

3.3 Weather and Unsuitable Conditions

Where a photography session is planned to take place outdoors, weather conditions may occasionally make it unsafe, impractical or unsuitable to carry out the session as intended.

Where possible, we will discuss the situation with you and may:

·       proceed with the session where conditions reasonably allow;

·       offer an alternative location;

·       rearrange the session for another suitable date; or

·       where a suitable alternative cannot reasonably be agreed, cancel the session and deal with any payments in accordance with Section 3.6.

We will always consider the safety of everyone involved and the likely effect of the conditions on the planned photography session.

3.4 Venue or Location Problems

Occasionally, a venue or agreed location may become unavailable or unsuitable for reasons outside our reasonable control.

Where this happens, we may:

·       try to arrange a suitable alternative venue or location;

·       rearrange the photography session for another suitable date; or

·       where neither option is reasonably possible, cancel the session.

If an alternative venue involves additional costs, we will discuss these with you before making any new arrangements.

3.5 Equipment Failure

We take reasonable care to maintain and prepare our photography equipment. However, unexpected equipment failure can occasionally occur.

If equipment failure means that we are unable to carry out your photography session, we will make reasonable efforts to rearrange the session for another suitable date.

If a suitable alternative date cannot reasonably be agreed, we will refund any payments received for the photography session.

3.6 Refunds and Payments Where We Cancel

Where we cancel a photography session and a suitable alternative date cannot reasonably be agreed, we will provide a full refund of all payments received from you for the photography session, including the booking fee.

If we need to cancel or rearrange a photography session, we will not normally be responsible for any additional costs you may have incurred in connection with the session, such as travel, accommodation or other personal arrangements, except where we are legally required to do so.

3.7 Circumstances Outside Our Reasonable Control

Sometimes events happen that are outside our reasonable control and which may prevent us from carrying out a photography session as planned.

These may include, for example:

·       serious illness or injury;

·       family emergency;

·       severe or dangerous weather;

·       vehicle breakdown;

·       significant road closures or travel disruption;

·       venue closures or unexpected loss of access to an agreed location, for example because of emergency works, flooding, safety restrictions or withdrawal of permission;

·       power outages;

·       government restrictions;

·       unexpected equipment failure; or

·       other circumstances beyond our reasonable control.

If such circumstances affect your photography session, we will contact you as soon as reasonably possible and will work with you to find a suitable solution, which may include rearranging the session.

If we are unable to provide the session and cannot reasonably agree an alternative arrangement, Section 3.6 will apply.

3.8 Your Statutory Rights

Nothing in these Terms & Conditions is intended to limit or exclude any rights you may have under applicable UK consumer law.

4. CLIENT & SESSION RESPONSIBILITIES

4.1 Preparing for Your Session

We want your photography session to be relaxed, enjoyable and successful, and we will do everything reasonably possible to help you get the best from your session.

We ask that you provide us with accurate and relevant information about the session, including the people who will be attending, the location you have requested and any particular requirements or circumstances that may affect the photography.

We also ask that you and anyone attending the session make reasonable efforts to work with us so that we can achieve the best possible results.

Photography can sometimes involve a little patience, particularly where children, pets or larger groups are involved. We understand that people and animals do not always behave exactly as expected, and we will do our best to work with the circumstances and adapt where reasonably possible.

4.2 Children and Young People

Where children or young people are attending a photography session, we ask that a parent, guardian or other responsible adult remains present and appropriately supervises them throughout the session.

We understand that children may become tired, distracted, upset or simply decide that they would rather not have their photograph taken. We will do our best to work with them and allow reasonable breaks where appropriate.

However, we are unable to guarantee particular photographs or results where a child or young person is unwilling or unable to participate.

The booked session time will remain as agreed, including where reasonable breaks or additional time are needed as a result of circumstances involving children attending the session.

4.3 Pets and Animals

We are very happy to include pets and animals in photography sessions where this has been agreed in advance.

We ask that pets and animals are brought to the session in a manner that is appropriate for their safety and welfare.

The owner or responsible person remains responsible for the behaviour, welfare and safety of their pet or animal throughout the session.

We understand that animals can be unpredictable and may not always do exactly what is expected of them. We will do our best to work with them and adapt the session where reasonably possible, but we are unable to guarantee particular photographs or results involving animals.

4.4 The Booking Contact and Nominated Representative

The person making the booking will normally be our main point of contact for the photography session.

Where the person making the booking will not be attending, we ask that they nominate an adult who will be present as the main point of contact for the session.

This person should be able to discuss any practical issues with us and, where reasonable, help us communicate with and organise the people attending.

The nominated representative should be made known to us before the session where possible.

By making a booking, you agree that we may reasonably rely on the booking contact or nominated representative to assist with practical decisions relating to the photography session where the person making the booking is not present.

4.5 Behaviour, Safety and Respectful Conduct

We want everyone involved in a photography session to feel comfortable, safe and respected.

We understand that photography sessions can sometimes form part of celebrations or social occasions. However, we ask that everyone attending behaves in a respectful and considerate manner towards us and anyone else involved in the session.

If the behaviour or condition of any person attending the session, including as a result of alcohol or other substances, creates a safety concern or makes it difficult to carry out the session as planned, we will first endeavour to discuss the situation with the booking contact or nominated representative and find a reasonable and workable solution where possible.

We may pause the photography session while this is discussed.

4.6 Location, Access and Safety

Where you have chosen a location for your photography session, we will, where reasonably possible, assess the location in advance to consider whether it is suitable for the planned photography.

Our assessment may identify practical, environmental or safety considerations that mean the location is not suitable for the session as planned. If this is the case, we will discuss this with you and, where reasonably possible, agree an alternative location or other suitable arrangement.

Where you have chosen or arranged the location, you are responsible for making any necessary arrangements for access and obtaining any required permissions, unless we have agreed otherwise with you.

If, when we arrive at the agreed location, access is unexpectedly unavailable or the location cannot reasonably be used for reasons outside both your and our control, we will first try to find a practical solution. This may include finding an alternative location or rearranging the session for another suitable date.

If you choose not to proceed with an alternative arrangement and instead decide to cancel the session, we will treat this as a cancellation by you. However, where the circumstances leading to the cancellation were outside both your control and ours, we will, as a gesture of goodwill, retain only the booking fee and any other unavoidable, non-refundable costs already incurred specifically for your session. Any remaining amount you have paid will be refunded to you.

If there are any known hazards, access difficulties, animals, building works or other circumstances that may affect the safety or practical operation of the session, please let us know before the session wherever possible.

If we reasonably consider that a location or situation presents a safety risk to us, you or anyone attending the session, we may pause or end the session and/or discuss an alternative arrangement.

4.7 If Difficulties Arise During Your Session

Sometimes circumstances arise during a photography session that are unexpected or outside anyone's control.

Where a difficulty arises, our first approach will be to discuss the situation with the booking contact or nominated representative and, where reasonably possible, work together to find a practical solution.

This may include taking a short break, changing the approach to the photography, changing the location within the agreed area or making other reasonable adjustments.

If a difficulty cannot reasonably be resolved and the session has to be ended early because it is no longer safe or reasonably possible to continue, no refund will normally be due for work or session time already provided.

Nothing in this section is intended to limit or exclude any statutory rights you may have under applicable UK consumer law.

5. IMAGES, PROOFS & PHOTOGRAPHIC PRODUCTS

5.1 Selection of Final Images

Following your photography session, we will select approximately 24 to 36 final images from the session. The selection will be made using our professional judgement and will reflect as far as reasonably possible the agreed style and purpose of your photography session.

The number of final images will be within this range unless a different arrangement has been agreed with you in writing.

5.2 Proofs and Online Gallery

The selected images will initially be made available for viewing through a private online gallery.

Access to the online gallery will be limited to you and us.

The proof images will receive minor editing for viewing and selection purposes only and are not representative of the final edited images supplied as products.

The online gallery is intended to allow you to view and select the images you wish to purchase as digital images and/or physical photographic products.

Where accessing or ordering through the online gallery is problematic, a digital proof sheet may be made available to you on request.

Proof images are intended for viewing and selection only and are not intended for printing, publication or other use unless we have specifically agreed otherwise with you.

5.3 Digital Images

Where you purchase digital images, the final edited images will be supplied in a high-resolution, print-ready format suitable for personal printing.

The digital images supplied for printing are intended for your personal use, subject to the rights and permitted uses set out elsewhere in these Terms & Conditions.

The final digital images will reflect our professional editing and creative style.

We do not supply RAW files or other unedited files.

5.4 Online-Sharing Images

Where digital images are purchased, we will also provide a separate set of lower-resolution, watermarked images intended solely for sharing online.

These images are provided for use on social media, websites and other online platforms where appropriate.

The watermarked online-sharing images are not suitable for printing and should not be used as a substitute for the high-resolution digital images supplied for printing.

The watermark must not be removed, obscured, altered or cropped out.

5.5 Printed Images & Framing

We also offer physical photographic products in the form of professionally printed images, presented in our signature gallery-standard frames.

Our framed photographs are prepared to a high standard and are intended to provide a finished piece of photographic art for display.

Where we are able to personally deliver a framed photograph, we will arrange delivery with you following your purchase.

Because our standard frames contain glass, personal delivery may not always be possible depending on your location and the practical arrangements involved.

5.6 Delivery of Physical Products

Where we are unable to personally deliver a framed photograph, we may offer the following alternatives:

·       the printed photograph without a frame, supplied at the applicable reduced price; or

·       a framed photograph using a high-quality, safer alternative to glass where appropriate for secure delivery.

Where a print-only option is chosen, the photograph will be securely packaged and delivered using an appropriate courier service, normally in a protective tube or other suitable packaging.

Where a framed photograph is supplied using a safer alternative to glass, the material used will be selected to provide a high-quality finish while reducing the risk of breakage during delivery.

The available delivery and presentation options will be discussed with you before your purchase is confirmed.

5.7 Alternative Framing & Presentation

Our signature framed presentation forms part of the Culver House Photography style.

Other framing or presentation options may also be available from our limited range, depending on the photograph, size and availability.

Any alternative framing or presentation option, together with any additional cost, will be discussed and agreed with you before your order is confirmed.

5.8 Image Editing & Creative Style

Our final images will be professionally edited in keeping with our photographic style and the nature of the session.

We operate within a considered ethical framework when editing photographs. Our editing is intended to enhance and present the photograph, rather than substantially alter a person’s natural appearance or physical characteristics.

Normal photographic corrections may include adjustments to skin colour where appropriate, such as reducing temporary redness caused by warmth, exertion, lighting or the conditions of the photography session. These adjustments are intended to present the photograph naturally and do not involve changing a person’s natural skin tone.

As part of our ethical approach, there are certain edits that we will not undertake. These may include, but are not limited to:

·       lightening or darkening a person’s natural skin tone;

·       removing or substantially altering natural skin characteristics or physical attributes;

·       enlarging, reducing, adding or removing body parts, limbs or other physical attributes;

·       excessive or unrealistic changes to hair colour;

·       obvious or substantial ageing or de-ageing;

·       excessive skin smoothing or alteration of natural skin texture; or

·       any other alteration that we consider to be inconsistent with our ethical approach, photographic style or professional remit.

We are happy to discuss reasonable preferences or specific requirements with you, but we reserve the right to decline editing requests that fall outside our approach or would require excessive time or specialist work beyond the scope of the agreed photography service.

Where a requested edit would involve substantial additional work and is something we are able to undertake, we will discuss the requirement and any additional cost with you before carrying out the work.

5.9 Final Image Approval

Once you have selected the images you wish to purchase from the proof images or online gallery, we will carry out the final editing appropriate to the digital and/or physical photographic products you have ordered.

Before any physical products are printed or produced, we will provide you with an opportunity to view the final edited images and confirm that you are happy for us to proceed.

We ask that you check the final edited images carefully and let us know of any concerns before giving your approval.

Once you have confirmed that you are happy with the final edited images, this will be treated as your approval for us to proceed with the production of any physical products you have ordered.

Where physical products are produced following your approval, we will not normally be able to offer a refund or replacement because of a change of mind about the approved image editing, except where the product is faulty or we are otherwise legally required to provide a remedy.

Nothing in this section affects your statutory rights.

5.10 Ordering Period and Image Storage

You will have 10 days from the date your online gallery is made available to place your order. The ordering deadline will be clearly communicated to you when your gallery is made available and during the ordering process.

We understand that unexpected circumstances can sometimes make it difficult to place an order within the original timeframe. If we have not heard from you by the end of the 10-day period, we will send you a follow-up email and allow a further 72 hours for you to place an order or contact us.

If we do not hear from you within this additional 72-hour period, your images will be securely deleted in accordance with our data protection and image retention policies. Once deleted, the images will not be retained by us for future orders or recovery.

Where you place an order within the available ordering period, your images will be retained and stored in accordance with our Data Protection and Privacy Policy and our applicable image retention procedures.

Please refer to our separate Data Protection and Privacy Policy for further information about how we store, retain and delete personal data and photographs.

6. ORDERING PROCESS, FINAL APPROVAL & DELIVERY

6.1 Selecting Your Images

Following your photography session, we will select the images that we consider to be the strongest and most suitable from the photographs taken during your session.

We aim to provide approximately 24 to 36 selected images from your session, depending on the photographs taken and the nature of the session.

We will prepare these selected images with a soft edit for viewing purposes and make them available to you through a private online gallery.

The images shown in the gallery are proof images only. They are intended to allow you to view and choose the images you wish to purchase and are not representative of the final edited images supplied as part of your order.

6.2 Accessing Your Online Gallery

We aim to make your online gallery available within 7 days of your photography session.

We will provide you with the access details needed to view your gallery.

Your gallery will remain available for the ordering period set out in Section 6.7, unless we have agreed otherwise with you.

6.3 Choosing Your Images & Placing Your Order

Once you have viewed your gallery, you can select the images you wish to purchase and choose the format and presentation of your order.

Depending on the options available for your chosen image, this may include digital images, printed images, framed photographs and available sizes or presentation options.

The total price of your order will be confirmed before your order is processed.

Your order will be confirmed once your selections have been made and payment has been received.

6.4 Final Editing & Client Approval

Once your order has been placed and payment received, we will carry out the final editing of the images you have selected.

We will then provide you with the final edited images for approval before any physical products are sent for production. These approval images will be supplied in a lower-resolution, watermarked format and are provided for approval purposes only.

We ask that you review the final edited images carefully and let us know if you would like any reasonable final adjustments.

Where adjustments are requested, we will make any reasonable changes that fall within our agreed editing approach and provide the revised images for approval.

Once you have confirmed that you are satisfied with the final edited images, we will treat this as your final approval and proceed with the production of any physical products included in your order.

Your final approval is confirmation that you are satisfied with the final edited image. Please be aware that the appearance of a physical print may differ slightly from its appearance on a digital screen, due to differences between individual screens, displays and their colour and brightness settings.

6.5 Production & Checking Your Order

Once final approval has been received, we will send the relevant order to our chosen professional printers or suppliers for production.

We will check physical products when they are received by us. If we identify a fault or production issue, we will arrange for the affected item to be reprinted or replaced where appropriate before it is supplied to you.

Where framing has been purchased, we will arrange for the printed photograph to be professionally framed before delivery.

6.6 Delivery of Your Order

Where your location is within our personal delivery area, we will arrange to deliver your completed framed order to you personally.

Where personal delivery is not reasonably possible because of your location or other practical considerations, we may offer:

·       a print-only option, supplied securely by post or courier; or

·       a framed option using a suitable high-quality alternative to glass where appropriate for safe delivery.

The available delivery and presentation options will be discussed and agreed with you before your order is finalised.

6.7 Ordering Period & Cut-Off

You will have 7 days from the date your online gallery becomes available to place your order.

The ordering deadline will be clearly communicated to you when your gallery is made available.

If we have not received an order or heard from you by the end of the 7-day ordering period, we will send you a reminder and provide a further 48 hours in which to place your order or contact us.

The additional 48-hour period is the final extension under our standard ordering process.

If we do not hear from you within this additional period, the photographs from your session will be securely deleted in accordance with our applicable data protection and image-retention procedures. Once securely deleted, the photographs will not be available for future orders or recovery.

6.8 Circumstances Affecting the Ordering Period

We understand that circumstances can sometimes make it difficult to meet the standard ordering timeframe. For example, you may be away on holiday or dealing with a family emergency or other significant personal circumstances.

If you contact us and explain that you need additional time, we may agree an extension to the ordering period. Any additional time will be agreed with you on a case-by-case basis.

We ask that you contact us as soon as reasonably possible if you know that you may not be able to meet the stated deadline, so that we can discuss the situation with you.

6.9 Lead Times

We aim to make your online gallery available within 7 days of your photography session.

Following receipt of your paid order, we aim to complete your final editing, approval process, delivery of digital images and production and delivery of physical products within 28 days.

This 28-day timeframe is our normal target, provided that we receive your approval and any other information needed from you within the stated timeframes.

The 28-day timeframe includes the standard client approval period set out in Section 6.4. Where approval or other information is not provided within the stated timeframe, any resulting delay will be added to the estimated completion and delivery time.

We will contact you if we are waiting for your approval or any information needed to proceed.

Our stated lead times are estimates and may be affected by circumstances outside our reasonable control, including supplier or printing delays, courier or delivery disruption, severe weather, equipment failure or other unforeseen circumstances.

Where a delay occurs, we will keep you informed and will do our best to complete your order as soon as reasonably possible.

7. COPYRIGHT, IMAGE LICENSING & USE OF PHOTOGRAPHS

7.1 Copyright Ownership

All photographs taken by Culver House Photography remain the copyright of Culver House Photography.

Purchasing digital images, prints or other photographic products does not transfer copyright ownership to you.

Copyright remains with Culver House Photography unless we expressly agree otherwise with you in writing.

7.2 Image Licence Agreement

Your purchase of photographs does not provide unrestricted rights to use, reproduce or distribute the images.

Before placing your order, the Image Licence Agreement will be available to view online. It sets out the permitted uses of your purchased images and the restrictions that apply to them.

The Image Licence Agreement forms part of the terms under which your purchased images are supplied and should be read alongside these Terms & Conditions.

Before your purchased digital images and/or physical products are released to you, we will ask you to confirm your acceptance of the Image Licence Agreement.

7.3 Personal Use of Purchased Images

Purchased digital images are supplied for your personal use, subject to the terms of the Image Licence Agreement.

You may print your purchased high-resolution digital images for your own personal use and display your purchased photographs in your home or other personal space.

You may also share the supplied online-sharing images on your personal social media accounts or other personal online platforms, provided this is done in accordance with the Image Licence Agreement.

7.4 Restrictions on Use

Your purchased images may only be used in accordance with the Image Licence Agreement.

The licence agreement sets out the uses that are permitted and those that are not permitted, including restrictions relating to commercial use, alteration, reproduction, distribution and other uses of the images.

If you would like to use an image in a way that is not covered by the Image Licence Agreement, please contact us before doing so. We may be able to provide additional permission or agree a separate licence for the proposed use.

7.5 Additional Licensing & Permissions

If you would like to use one of our photographs for a purpose that is not permitted under the Image Licence Agreement, please contact us before using the image.

We may, at our discretion, grant additional permission or agree a separate licence for a particular use. Any additional permission or licence must be agreed with us in writing before the proposed use takes place and may be subject to an additional fee.

Any additional permission granted will apply only to the specific use agreed and will not transfer copyright ownership unless expressly agreed in writing.

7.6 Copyright & AI

Our photographs must not be uploaded to, submitted to or used by artificial intelligence systems or other automated image-generation, image-training or image-manipulation services unless expressly permitted under the Image Licence Agreement or agreed with us in writing.

The Image Licence Agreement sets out the restrictions relating to the use of our photographs with artificial intelligence and other automated technologies.

7.7 Our Use of Your Images

Although copyright in the photographs remains with Culver House Photography, we recognise that the people and moments captured in those photographs are personal to you.

We therefore do not automatically assume that we may use your photographs for our own promotional purposes simply because we hold the copyright.

Where we would like to use photographs from your session for our website, portfolio, social media, advertising or other promotional purposes, we will seek the appropriate permission or consent from you, as applicable and as set out in our Model Release & Consent form.

We will always aim to be clear about how photographs may be used and to respect any agreed limitations on their use.

8. PRIVACY, DATA PROTECTION & IMAGE RETENTION

8.1 Your Personal Information

We will collect and use personal information that is reasonably necessary to provide our photography services, manage your booking, process your order and communicate with you, whether electronically or in writing.

This may include information such as your name, contact details, booking information and other information you provide to us in connection with your session or order.

Payments are processed securely by third-party payment providers. We do not have access to or store your payment information.

We will handle your personal information in accordance with applicable UK data protection law and our Privacy Policy.

8.2 Photographs & Personal Data

Photographs may contain identifiable individuals and may therefore constitute personal data in certain circumstances.

We will handle photographs containing identifiable people responsibly and in accordance with applicable data protection requirements.

Our use of photographs for promotional or portfolio purposes is addressed separately in Section 7 and, where applicable, our Model Release & Consent form.

8.3 Storage & Security

We take reasonable steps to protect your personal information and photographs against unauthorised access, loss, misuse or disclosure.

Photographs and all other collected data are stored securely using appropriate physical and electronic storage measures. Where appropriate, electronic data is protected using encryption and other security measures, where reasonably necessary for the provision and management of our services.

Where photographs are displayed on our website or other public platforms by Culver House Photography, we take reasonable measures to discourage unauthorised copying, downloading or reproduction. However, no method of displaying images online can completely prevent determined third parties from capturing or reproducing them.

8.4 Image Retention

If you place an order, we will retain all photographs that were made available for you to purchase for 12 months from the date of your original order.

This means that if you later decide you would like to purchase additional images, we may be able to provide them during this period, subject to the options available at the time.

After 12 months, the photographs will be securely deleted in accordance with our Privacy Policy.

8.5 Our Privacy Policy

Our Privacy Policy provides further information about how we collect, use, store and protect personal information and photographs, including your rights under applicable data protection law.

Our Privacy Policy should be read alongside these Terms & Conditions.

9. QUESTIONS, CONCERNS & FEEDBACK

9.1 Working Together

We aim to provide a friendly, professional and transparent service at all times.

If you have any questions, concerns or feedback about your booking, photographs, products or any aspect of our service, we ask that you contact us as soon as reasonably possible so that we can work with you to understand the situation and, where appropriate, seek a fair and practical resolution.

9.2 Raising Concerns

Many issues can be resolved quickly through open communication, and we encourage clients to contact us directly before taking any further action.

We will consider any concerns fairly, taking into account the circumstances of the booking, the services provided and any information available to both parties.

9.3 Your Consumer Rights

Nothing in these Terms & Conditions affects your statutory rights under applicable consumer protection law.
